On national human rights institutions
The status of the Ombudsman has been significantly strengthened. It is now enshrined in the Constitution and the Constitutional Law.
Representatives of the Ombudsman in the regions have appeared. This significantly increases legal protection.
The Ombudsman works openly, and all information on his activities is available on his website, down to his annual reports.
As can be seen from the report, the number of appeals to the Ombudsman is growing rapidly. Last year they received 5,773, which is 1.5 times more than in the 22nd year and almost 3 times more than in the 21st year.
As a result of their consideration 282 persons were brought to responsibility (criminal - 20, administrative - 51, disciplinary - 211).
In general, last year the Commissioner assisted in restoring the rights of 902 people. Behind each figure there is a specific person, a family.
Kazakhstan also has Ombudsmen with special mandates (for children, persons with disabilities, business, insurance and banking).
Over the years of independence, non-governmental organizations have grown from 100 to 23 thousand.
Thus, Kazakhstan is a party to the main international human rights treaties and complies with them.
On freedom of assembly
A new Law on Peaceful Assemblies has been adopted.
The law has significantly expanded the rights of its participants. In order to hold a peaceful assembly, it is no longer necessary to obtain permission from the authorities - it is sufficient to notify the local administration. The timeframe for such notification and its consideration has been significantly reduced. Liability for violation of the order of assemblies exists only in case of a clear violation of public order and a threat to undermine state security.
Of course, there are refusals in assemblies and rallies, but they are related to other mass events, construction works, violation of notification terms, inadequacy of the chosen place for such a number of participants.
International law allows the prohibition of peaceful assemblies in the interests of the security of the protesters themselves.
