The Senate of the Parliament approved in two readings the law on ensuring the rights of women and the safety of children, as well as amendments to the Code of Administrative Offenses, the correspondent reports Tengrinews.kz .
The amendments are aimed at improving the legal, social, institutional and other foundations of state family policy, strengthening the protection of women's rights and child safety, tightening administrative and criminal liability for violations of their safety, and preventing violence in the family and household sphere.
"The Head of State instructed to toughen penalties for any form of violence against minors, as well as to institutionally strengthen the psychological support service in educational institutions, organize a single helpline and develop an effective program to help victims of violence and bullying, which is reflected in the laws submitted for consideration," said Senate deputy Zhanna Asanova.
The Law regulating women's rights and child safety introduces the following amendments to the Criminal Code:
prohibition on the imposition of a more lenient punishment than provided for in the special part of the Code when persons commit crimes related to violence against minors;
reconciliation of the parties for crimes related to violence against minors is excluded, as well as in cases of repeated commission of criminal offenses provided for in articles 108-1 a year after reconciliation ("Intentional infliction of minor harm to health") and 109-1 ("Beatings") of the Code;
for acts aimed at intentionally causing serious harm to health, moderate harm to health, an alternative punishment in the form of restriction of freedom is excluded and a punishment in the form of imprisonment is established;
The punishment is life imprisonment for the murder of a minor (Article 99 of the Criminal Code), the commission of rape against a minor (Article 120 of the Criminal Code) and for violent acts of a sexual nature against a minor (Article 121 of the Criminal Code) by excluding other alternative penalties provided for in the current norms of the Criminal Code;
Liability is introduced for sexual harassment of persons under the age of 16;
Punishment is established for inducing to commit suicide or assisting in the commission of suicide;
A new article is being introduced that establishes special requirements for the behavior of a person who has committed a criminal offense, applied by the court;
criminal liability for intentional infliction of minor harm to health and beatings by transferring them from the Administrative Code to the Criminal Code.
The deputies of the Senate voted for the approval of the law in the first and second readings. The document will be sent to the President for signature. It will enter into force after signing.
Recall that in February, the Mazhilis adopted a law on women's rights and child safety. The law provides for the criminalization of intentional infliction of minor harm to health, beatings, sexual harassment of persons under the age of 16, and propaganda of suicide.
