Today, the Senate considered the law on ensuring women's rights and child safety in the first reading. MP Darkhan Kydyrali asked if the law would come into force, whether Kazakh parents would be deprived of their parental rights more often.
"It is known that parents are deprived of their rights when harming the health of a child or another family member. Now, according to the law, criminal liability for causing minor harm to health is being restored. Won't this lead to the automatic deprivation of parental rights?" Kydyrali asked.
Deputy Minister of Internal Affairs Igor Lepekh recalled that the issue of deprivation of parental rights belongs to the competence of the guardianship authorities.
"In case of initiation, this issue is first considered by the Commission for the protection of the rights of minors. Then - by the court, where the totality of all circumstances is considered: the identity of the parents, the threats existing for the child. I think this will in no way affect the increase or decrease in the number of deprived of parental rights," the deputy minister said.
The speaker of the Senate, Maulen Ashimbayev, also spoke on this issue. He noted that the law on marriage and family has norms according to which parental rights are deprived in case of criminal offenses.
"But we do not see mass deprivation of parental rights. This has never happened in our history. Therefore, there is no reason, it is my opinion, that the law, if approved and signed by the Head of State, will lead to mass deprivation of parental rights. This is an incorrect and incorrect interpretation, there are no such norms in the law. Here we must make it clear to the public that the law is not aimed at depriving parental rights. It is aimed at protecting the rights of women and children," Ashimbayev said.
It should be recalled that Kazakhstanis have repeatedly wondered whether children would be removed from their families when the new law was adopted. In February, the Mazhilis denied these rumors.
